Judge defers ruling on motion in SourceGas lawsuit

[GLENWOOD SPRINGS, COLO.] – Yesterday, District Court Judge James Boyd deferred ruling on Colorado Mountain College’s motion for summary judgment regarding the validity of a lease with SourceGas that proposed a compressor station to be located on CMC’s Spring Valley campus. Judge Boyd set another status conference in the case for March 22, 2013, and said that he anticipated ruling on CMC’s motion at or before the March 22 status conference.

Judge Boyd previously ruled on Aug. 7, 2012, that the college could not be forced to allow SourceGas to locate the compressor station on CMC property. A trial is currently set to begin June 26, 2013.

SourceGas subsidiary Rocky Mountain Natural Gas filed a lawsuit against the college in May 2012 after CMC’s board of trustees voted not to recognize a lease for a compressor station that the company sought to locate on the college’s Spring Valley campus. The board’s vote occurred after neighboring property owners, CMC students, faculty and staff, and other members of the public voiced concerns about and opposition to locating the compressor station on college property at a public meeting before the Garfield County Planning & Zoning Commission on March 14, 2012, and at subsequent public meetings convened by CMC and SourceGas to address these concerns.
